Terms of Service

1. Introduction and Contractual Acceptance

Creovant is a digital platform operated from 253 Sea Country Lane, Rancho Santa Margarita, California, United States. These Terms of Service govern access to the platform, marketplace, messaging tools, community features, and related services.

By creating an account, accessing the platform, or using any feature, you agree to be bound by these Terms. Electronic acceptance and records have the same legal effect as paper documents and handwritten signatures where allowed by law.

Creovant is available across multiple jurisdictions. If local mandatory law gives you non-waivable rights, those rights control over any inconsistent provision in these Terms.

2. Eligibility

You must be at least 16 years old, or the minimum legal age required in your place of residence to use digital services or enter into a contract.

You must provide accurate, complete, and current information and keep it updated.

You are responsible for maintaining the security of your account credentials. We recommend a strong password and two-factor authentication. Suspected unauthorized use should be reported to operations@creovant.app.

You may not sell, lend, license, or transfer your account, username, or identifiers without prior written permission. Creovant may reclaim or modify usernames or identifiers at its discretion.

3. User Profiles, Identity, and Organizations

You may not impersonate another person or entity, misrepresent affiliations, use deceptive credentials, or provide false or misleading information about your identity, qualifications, or organization membership.

Creovant may offer team or organization features, profile visibility controls, badges, and organization-only spaces. Those settings may vary by product feature and published policy.

Access requires an official Creovant account, and all submitted information must be truthful and accurate.

4. Acceptable Use and Community Safety

You may not use Creovant for fraud, scams, harassment, hate speech, illegal activity, or misuse of messaging, servers, or group spaces.

Creovant may enforce these Terms through warnings, suspensions, bans, content removal, feature restrictions, demonetization, or account termination where necessary to protect safety, integrity, legal compliance, or platform reliability.

Users may report suspected violations to operations@creovant.app. Where permitted or required by law, Creovant may disclose relevant information to regulators, law enforcement, rights holders, or affected users.

5. User Content and Platform License

You retain ownership of the content you create, upload, or submit to the platform.

You grant Creovant a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt for technical purposes, publish, display, perform, distribute, and otherwise process your content as needed to operate, improve, secure, promote, and provide the platform and related services, subject to your settings and our Privacy Notice.

You represent that you have all rights, permissions, consents, and legal bases needed to upload your content and grant this license.

6. Copyright and Intellectual Property

Creovant and its licensors retain all rights in the platform, including software, branding, design, text, graphics, databases, and other platform content excluding user content.

You agree to respect the intellectual property rights of others. Repeat infringers may be suspended or terminated where appropriate and lawful.

If you believe content infringes your copyright, trademark, or other rights, send a written notice to operations@creovant.app with enough information for us to identify the work, the allegedly infringing material, the basis for your claim, and your contact details. Creovant may remove or disable content during review and may allow a counter-notice or appeal where applicable.

7. Networking and Communication Tools

Creovant may provide private messaging, group chats, servers, friend systems, and related networking tools. You remain solely responsible for the content you share through those spaces.

8. Marketplace, Listings, and Transactions

Creovant facilitates transactions and ordinarily acts as a venue, not the seller of goods or services. Unless a checkout flow expressly says otherwise, the contract for sale is between the buyer and the seller or service provider.

Sellers are responsible for listings, legality, quality, fulfillment, invoicing, taxes, warranties, and after-sales support. Sellers must comply with all laws applicable to their listings and conduct, including consumer, labeling, advertising, tax, sanctions, export, licensing, and invoicing requirements.

Users must provide accurate listing descriptions, complete delivery of goods or services, and issue paper or electronic invoices or receipts where required.

Illegal goods or services, counterfeit goods, stolen property, sanctioned items, regulated products without permission, or any listing prohibited by policy are not allowed.

Nothing in these Terms excludes or limits any non-waivable consumer rights that apply under law, including rights for defective or misdescribed goods, digital content, subscriptions, or services.

9. Platform Currency, Wallet, and Payments

Creovant may offer a wallet, stored value, points, credits, or other balance mechanisms for platform use. These features are contractual platform tools and may be subject to additional rules shown in-product.

Payments may be handled by third-party processors such as Stripe or similar providers. Your use of those payment services may also be governed by the provider's own terms, privacy notices, onboarding requirements, and compliance standards.

10. Mentorship, Services, and Seller Responsibility

Where Creovant facilitates mentorship, advisory, or service-based transactions, the provider remains responsible for the substance, performance, legality, and quality of those services. Mentors and service providers act as independent contractors, not employees of Creovant.

11. Refund Policy

Refund eligibility, cancellations, and re-performance rights are governed by the seller's terms, the applicable checkout flow, and any mandatory consumer laws that apply to the transaction.

As a baseline marketplace standard, buyers may seek relief for non-delivery, significant mismatch, defect, or suspected unauthorized or fraudulent transactions. Buyers should generally contact sellers within 14 days after delivery or the expected delivery date unless a longer period applies. Sellers should respond within 7 business days, after which unresolved matters may be escalated to Creovant.

Creovant may request photos, videos, communications, or other evidence. Claims may be denied and accounts restricted where abuse, false claims, manipulation, or friendly fraud is reasonably indicated.

12. Privacy, Data Protection, and Cross-Border Transfers

Creovant processes personal data in accordance with its Privacy Notice and applicable privacy laws, which may include the GDPR, UK GDPR, Data Protection Act 2018, CCPA and CPRA, Singapore PDPA, Philippine Data Privacy Act, and similar laws depending on where the service is offered and where users are located.

Where applicable law gives rights of access, correction, deletion, restriction, objection, portability, appeal, or opt-out, Creovant will honor those rights subject to legal and verification requirements.

Creovant may send service communications needed to operate your account. Marketing communications are sent only as allowed by applicable law, and opt-out controls will be provided where legally required.

13. Platform Availability, Changes, and Beta Features

Creovant aims to keep the service available and secure, but does not guarantee uninterrupted, error-free, or continuous operation.

Features may be modified, suspended, or discontinued at any time for legal, security, operational, or product reasons.

Beta, preview, and experimental features are offered as-is and may be changed or removed at any time.

14. Termination and Account Suspension

You may stop using the platform and close your account at any time, subject to outstanding transactions or legal retention requirements.

Creovant may suspend or terminate access where it reasonably believes you breached these Terms, created legal or security risk, engaged in fraud or abuse, or where continued service is unlawful or impracticable.

After termination, provisions that should survive by their nature, including payment obligations, licenses already granted, indemnity, liability limits, and dispute provisions, remain in effect.

If a balance, reserve, or pending payout exists at termination, Creovant may retain, offset, or release amounts as reasonably necessary to complete transactions, resolve disputes, cover chargebacks, or comply with legal obligations.

15. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the platform is provided on an as-is and as-available basis. Implied warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement are disclaimed except where such disclaimers are not allowed.

Creovant is not responsible for third-party content, listings, integrations, websites, or service outages, although it may choose to intervene or moderate where appropriate.

Creovant is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or data.

Creovant's aggregate liability arising out of or relating to the platform or these Terms will not exceed the greater of the amounts you paid to Creovant in the 12 months before the claim arose or 10 United States dollars, except where a greater minimum is required by applicable law.

16. Indemnity

You agree to indemnify and hold harmless Creovant, its affiliates, and their officers, directors, employees, and agents from claims, liabilities, losses, and expenses arising out of your user content, misuse of the platform, listings or services, or breach of these Terms.

17. Disputes and Resolution

Before filing a complaint, parties should use Creovant's internal redress process by sending written complaints to disputes@creovant.app. This does not prevent urgent injunctive relief, regulatory reporting, or non-waivable statutory rights.

These Terms are governed by the laws of the United States, excluding conflict of law rules, unless mandatory law in your place of residence requires another law or preserves local consumer protections.

Disputes not resolved informally will be brought in the courts designated by Creovant unless applicable consumer law allows claims in your home jurisdiction or prohibits exclusive foreign venue clauses.

18. Changes to These Terms and Miscellaneous

Creovant may update these Terms from time to time and will provide notice by reasonable means such as email, in-product notice, or an updated posting date. Continued use after the effective date means you accept the updated Terms.

These Terms are the entire agreement regarding the platform unless a separate written agreement applies. If one provision is held unenforceable, the remainder stays in effect to the extent permitted by law.

You may not assign these Terms without consent. Creovant may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets. Failure to enforce a provision is not a waiver.
